Byzantine Art Essay There are many differences and similarities between the following two pieces of art; the Toreador Fresco and the Egyptian Fowling Scene. The Toreador Fresco is a fresco depicting a bull-leaping ceremony. It is from the palace at Knossos(Crete), Greece and from around 1450-1400 BCE. The Egyptian Fowling Scene is a mural painting from the tomb of Nebamun. It is from Thebes, Egypt and from the 18th Dynasty, ca. 1400-1350 BCE. The styles between these two periods are very different, but there are still a few similarities found between the two pieces of art. The Toreador Fresco depicts a bull in the center, and a man leaping over its back. There is a woman on each side of the bull. Unlike the Fowling Scene, this fresco includes a border. In the Egyptian Fowling Scene, Nebamun is standing in his boat, flushing birds from a papyrus swamp. He is holding his throwing stick in one hand and three birds in the other hand. He is accompanied by his wife and daughter who are both shown holding lotus flowers. In the Toreador Fresco, the bull is the central figure of the painting while in the Fowling Scene every space was filled with lively details such as lotus flowers and butterflies. As for the depiction of the human figure, in the Toreador Fresco, the human figures have stylized shapes with pinched waists and they are highly animated. Also, in order to distinguish between male and female, the artist painted the young women with fair skin and the man with dark skin. This was a widely accepted ancient Minoan convention. This is very different from the depiction of human figures in the Fowling Scene. The skin color of Nebamun, his daughter and his wife are all the same dark color. The artist scaled down their figures in proportion to their rank. The wife and daughter were much smaller than Nebamun. Also, in the Fowling Scene, the animals show a naturalism based on careful observation. One similarity between the paintings was that the human figures were painted with the profile pose with the full-view eye. Another similarity between the two paintings would be that they both represent rituals and traditions. The Toreador Fresco depicts the Minoan ceremony of bull-leaping while the Fowling Scene is a tomb painting showing that Nebamun is enjoying himself in the afterlife. Another difference would be that in the Toreador Fresco, the artist used curved lines to suggest the elasticity of the living and moving beings unlike the Fowling Scene where the depiction of movement was not represented very well. In the Toreador Fresco, the artist also elongated the animal’s shape to show the powerful charge of the bull and used sweeping lines to form a funnel of energy. It is easily seen how the depiction of movement is better represented in the Toreador Fresco than in the Fowling Scene. In the Fowling Scene, the artist used many different and lively colors whereas in the Toreador Fresco, there is not a great variety of colors used. In the Toreador Fresco, you can tell that it is Minoan art by the elegance of the Cretan figures, with their long, curly hair and proud and self-confident bearing. This distinguishes them from all other early figures styles. You can also see a few cultural differences between the two periods just by comparing the two paintings. The human figures in the paintings are all dressed much differently. Also, in ancient Egypt, the artists often used hierarchal scale in their paintings. They would make the size of the human figures larger based on their social status. That is why in the Fowling Scene, the wife and the daughter of Nebamun are much smaller than him. Whereas, in the Toreador Fresco, you do not see a hierarchal scale, the human figures are all the same size. In conclusion, there are many differences and similarities between the Toreador Fresco and the Fowling Scene. Both paintings represent rituals and traditions. Also, they both have figures painted with the profile pose. In the Toreador Fresco, it includes a border and the bull is the central figure. The human figures are wasp-waisted, and highly animated. The depiction of movement is much better represented in this piece of art than the Fowling Scene because the artist used curved lines to emphasize the movement of the figures. He also elongated the bull’s shape to show the powerful charge of the animal and used sweeping lines to form a funnel of energy. In comparison, in the Fowling Scene, the artists filled every space with lively details. The marsh is full of lotus flowers and butterflies. Although the depiction of movement is not shown as well as the Toreador Fresco, a variety of lively colors is shown in the painting. Unlike the Toreador Fresco, the hierarchal scale is shown in the Fowling Scene.

Teacher-Student Interaction Being able to determine what teachers expect from students and what students expect from teachers is the key to creating positive classrooms that work. Teacher-Student interaction is a two way street; The students relate to the teachers, and the teachers relate to the students. If teachers develop and build upon self-esteem and mutual respect within their classrooms, the teachers will achieve positive relationships with the students. Many years ago, power relationships and authority figures in our society were clearly defined. Dad ruled the household; moms and kids complied. Bosses ruled the work-place, and the workers who were brave enough to challenge them would lose their jobs. Within this ranking order students were at the bottom. Students ideas and choices were unimportant, they were not heard. Today, all of this has changed, and every person in this society demands equality. Today we are able to speak up and have our needs and wants recognized. In many cases the college studen t is encouraged and expected to be candid in responding to the teacher's ideas, methods, or words. Teachers have to learn how to sidestep their power and allow student to exercise their own personal power in ways that enhance the classroom atmosphere while at the same time satisfying the students individuality. Teachers must allow the students to contribute to the class group in their own unique ways. A student should be encouraged and given the opportunity to participate in the classroom by voicing his /her ideas in a comfortable and non-pressured classroom. Marc Shachtman, a student from Ohio Oberlin College said, "In a course I took last year a maverick student said he agreed with a supreme court justice's view t... ... to get across, you must first let your message be known. Professors should be able to transmit trust to the students, they should create a comfortable and healthy atmosphere in their classroom by allowing the students to be both reactive and proactive in the classroom. Is an invitation to treat an offer? Discuss? Essay

Answer: Section 2(a), Contracts Act 1950 provides that ‘when one person signifies to another his willingness to do or to abstain from doing anything, with a view to obtaining the assent of that other to the act or abstinence, he is said to make a proposal’. Case: M N Guha Majumder v R E Donough [1974] 2 MLJ 114 Facts: Property owned by the defendant was advertised for sale, and written offers to purchase were invited. The plaintiff viewed the property on two occasions. During the interval between the two occasions the plaintiff was in communication with the defendant’s agent, and it was alleged that the defendant had accepted the plaintiff’s offer to purchase the property for RM70,000. There had been on the occasion of the second visit to the property some discussion on the mode of payment. There was also no clear agreement on the sale of orchid plants which the defendant wished to sell separately, although the matter was discussed between the parties. The defendant denied that he had decided to go on with the sale. The defendant was anxious, however, to effect a quick sale as he was desirous of leaving Kuching permanently for Johor bharu. Issue: Whether there was a contract inexistence between the plaintiff and the defendant at the material time. Held: 1. The law does not impute an intention to enter   into such a legal relationship as that of vendor and purchaser where the circumstances and the conduct of the parties negative any intention of the kind. 2. The evidence indicated that the parties did not intend to be immediately bound. They had not the necessary animus contrahendi (means intention to contract). What passed was only a negotiation from beginning to end. Whether an advertisement is an offer or an invitation to treat depends on the intention of the parties in each case. The courts have held that  advertisements of bilateral contracts are not offers whereas advertisements of unilateral contracts are construed to be offers. In the case of Majumder v Attorney-General of Sarawak, the Federal Court held that an advertisement in the newspaper for the post of a doctor was an invitation to treat. When an auctioneer invites bids, he is merely making an ‘invitation to treat’, and when a bidder makes a bid, he is making an offer. The contract, i.e. the sale, is only made when the auctioneer announces its completion by the fall of the hammer. Similarly, a display of goods in a shop is an invitation to treat. An offer to buy is made when the customer puts the articles in a basket provided by the shop or takes the item off the shelf. The contract is only made at the cashier’s desk when the customer pays for the items. However, if it is clear in the circumstances that a party intends their words or conduct to constitute an offer, then the courts will be prepare to construe it as such. For example, in Carlill v Carbolic Smoke Ball Co. Ltd [1893] 1 QB 256, the advertisement of a unilateral contract was held to be an offer. Case: Carlill v Carbolic Smoke Ball Co. Ltd [1893] 1 QB 256 Facts: Carbolic Smoke Ball Co. Ltd. Advertised that they would offer  £1,000 to anyone who still succumbed to influenza after using a certain remedy for a fixed period. The plaintiff duly used it but, nevertheless, contracted influenza. The plaintiff then sued for the money. Held: The plaintiff was entitled to the  £1,000 as she had accepted the offer made to the world at large. To summarize, an invitation to treat is not an offer, but rather is an offer to consider offers. Instances which are generally regarded as invitations to treat include: -Auctions; -Advertisement of tenders; -Catalogues; -Price lists; and -Goods displayed in shop windows and shelves.

Have you ever felt unsafe going to school, have you ever been bullied, or have you ever just had negative thoughts about how to go on with life? When people are bullied they feel unsafe and without them feeling safe it makes them in a unwanted environment and have negative thoughts about life. It is very important for teachers to take a bigger approach on bullying because it can go undetected, be harmful to students, and have a negative impact on families. This also will make the environment where the bullying is taking place a negative place for others. Other people may say that they should just move then they can have a fresh start. Basically the authors are stating that if bullying is going undetected then it could get life threatening and also if the parents and teachers could create a bond with their child or student then maybe they the children could feel safe enough to open up to them.
